A doctor in the Palghar region of Maharashtra is facing charges related to the alleged carelessness that resulted in the death of Rupesh Lalman Gupta, 27, on March 19, 2024. A day before he passed away, Gupta was sent to the doctor’s hospital in Vasai. His family has accused the doctor of not giving him the proper care, specifically saying that the hospital failed to offer the oxygen assistance he needed, which they believe played a part in his demise.
When Gupta passed away, the police first filed an accidental death report. But after more research, the case became more serious when reports from other authorities suggested that the death may have been caused by the doctor’s actions—or lack thereof. Serious medical care errors were mentioned in these papers, such as the non-provision of oxygen assistance, which Gupta’s family claims was an essential component of his treatment.
Along with these worries, the doctor has also come under fire for not supplying any documentation or medical records that would have described the care Gupta had while in the hospital. The doctor was so charged by the authorities under Section 304 of the Indian Penal Code (IPC), which addresses “culpable homicide not amounting to murder.” This provision applies when someone is judged to have acted with extreme carelessness or negligence, causing the death of another person without intending to kill them. Authorities’ decision to charge the doctor with this provision implies that they think Gupta’s treatment included a high degree of negligence.
This instance emphasizes the value of receiving the right medical attention and the duty placed on medical personnel to save lives, particularly in dire circumstances. The Gupta family is pursuing justice, and the investigation’s conclusion may establish a significant standard for the treatment of medical malpractice cases in India.
